About these terms

These terms cover work by IN SYNC (run by Himanshu Bairagi and Ashish Nandardhane, Nagpur, Maharashtra, India) for you, and your use of this website and our apps. If your written quote or agreement says something different, the quote wins for that project.

Quotes

• We start with a call or a visit, then send a fixed quote in writing: what we will make, the price, the timeline and what you need to give us (menus, photos, logins, approvals).
• A quote is valid for 30 days.
• Work starts when you accept the quote in writing (WhatsApp or email is fine) and pay the advance.
• If you ask for something outside the quote, we tell you the extra cost and time first, and only go ahead when you agree.

Payment

• Custom work: 50% advance to start, 30% when you approve the design or a working version, and the rest before launch or handover. Your quote can set a different split.
• All prices are in Indian rupees and exclude GST, which we add at the current rate.
• Payment by UPI or bank transfer within 7 days of each invoice.
• If a payment is more than 15 days late, we may pause the work, or the app’s plan, until it is paid. We will tell you before we do.
• The advance covers work already started and is not refundable once design or development has begun. If we stop a project ourselves, we refund what you paid for work we have not delivered.

Ready-made apps and yearly plans

• Our own apps are licensed, not sold: you get the right to use them for your business while your plan is active.
• Plans are yearly, with a one-time setup fee; your quote shows both. Premium add-ons are priced separately.
• If you are switching from another app, we move your menu, customers and rates for free.
• Each app needs our approval to start, and keeps working while the plan is paid. If a plan ends, the app stops taking new bills after a grace period of 15 days. You can ask for an export of your data before then.
• Your business data stays yours. We use it only to run and support the app for you (see the privacy policy).

Festival greetings plan: payment, delivery, cancellation and refunds

This section covers the festival greetings plan bought at insync-studio.web.app/greetings. Where it differs from the rest of these terms, this section wins for that plan. The same rules are on their own pages too: refunds and cancellation and delivery.

What you get

• For one year from the day you pay: personalised festival greetings for your business. That means Diwali, Holi, Eid, Ganesh Chaturthi, Christmas, New Year and the other festivals we agree with you.
• Each greeting carries your logo and branding, the name of each person on the contact list you give us, and your call to action (for example your phone number or website).

Price and payment

• The price is ₹1,000 for the year, paid in full when you order. IN SYNC is not registered for GST, so no GST is charged.
• Payments are processed by Razorpay. You can pay by UPI, card, net banking or wallet. We never see your card or bank login.

Delivery

• Everything is delivered digitally, as image files on WhatsApp or by email. There is no physical shipping.
• Your first greetings are ready within 24 to 48 hours after you pay. If your logo or contact list reaches us later, the 24 to 48 hours count from when we have both. Greetings for each later festival reach you before that festival.
• If anything in a greeting is wrong (a name, the logo, a number), tell us and we fix it free.

Cancellation and refunds

• You can cancel for a full refund at any time before we deliver your first greetings. Message or call us.
• Once your first greetings are delivered, the year's plan is not refundable. We still fix any mistake free.
• If we cannot deliver the plan, we refund you in full.
• Refunds go back to the way you paid, through Razorpay. Banks usually show them within 5 to 7 working days.

Your contact list

• You confirm you are allowed to use the names on the list you send us.
• We use the list only to make your greetings. We never contact the people on it ourselves.
• We delete the list when the year ends, or sooner if you ask.

Who owns what

• Once you have paid in full, you own the custom design and content we made only for you: your logo, brand files, print artwork and website content.
• Custom software built only for you is yours once it is fully paid, and we hand over its source code on request. Our own reusable tools and code libraries inside it stay ours; you get a permanent licence to use them as part of your project.
• We keep the rights to our own tools, code libraries and ready-made apps, which we reuse across projects.
• Fonts, stock photos and third-party services (for example payment gateways, SMS or WhatsApp) come under their own licences and fees.
• We may show the work in our portfolio, unless you ask us not to.
• You confirm that anything you give us (logos, photos, text) is yours to use.

Support after launch

• Custom projects include 30 days of free fixes for anything that does not work as agreed.
• After that, support is part of your yearly plan, or a support package priced in your quote.
• Help is on one WhatsApp number, +91 97668 06261, 10am to 7pm, Monday to Saturday. We aim to reply the same working day.
• Updates to our apps are sent straight to the app.

Limits and responsibilities

• We build carefully and test before launch, but no software is free of faults. We fix faults in our work as described above.
• Our total liability for a project is limited to the amount you paid us for it in the last 12 months. We are not responsible for indirect losses, such as lost profit.
• You are responsible for keeping your logins safe, and for the prices, taxes and content you enter into an app.
• We are not responsible for outages of services we do not control, such as internet, Google, WhatsApp or payment providers.

Ending a project

Either of us can end a project with written notice. You pay for the work done up to that point, and we hand over what is finished and paid for.

Law

These terms follow the laws of India. If we cannot settle a disagreement by talking, the courts of Nagpur decide.
